1. GENERAL

1.1. These Terms & Conditions apply to products purchased via Chitra Art's website or placed through Social Media, offline on phone, chat, or through our Customer Service Team.

1.2. PLEASE READ THE TERMS & CONDITIONS CAREFULLY BEFORE PURCHASING ANY PRODUCTS OR AVAILING ANY SERVICES ON ANY ASSET OF CHITRA ART. ANY PURCHASE MADE BY YOU THROUGH THE WEBSITE OR THROUGH ANY OTHER ASSET SHALL SIGNIFY YOUR ACCEPTANCE OF THE SUPPLY TERMS AND YOUR AGREEMENT TO BE LEGALLY BOUND BY THE SAME. IN ADDITION TO THE FOREGOING, YOU SHALL ALSO BE BOUND BY THE TERMS OF USE OF THE WEBSITE, PRIVACY POLICY, TERMS BY THE VENDOR OR ADDITIONAL TERMS OF SERVICE WHICH ARE DISPLAYED WITH THE SELECTION OF THE PRODUCT, IF ANY ("ADDITIONAL TERMS"). IF THERE IS ANY CONFLICT BETWEEN THE SUPPLY TERMS AND THE ADDITIONAL TERMS, THE ADDITIONAL TERMS SHALL TAKE PRECEDENCE IN RELATION TO THAT SALE.

1.3. IF YOU DO NOT AGREE WITH THE SUPPLY TERMS, PLEASE DO NOT ACCESS THE WEBSITE OR ANY OTHER ASSET FOR ANY PURCHASE OR SERVICE.

2. BUSINESS

2.1. The website is a platform that facilitates the online sale and purchase of merchandise and services ("Services") offered by Chitra Art and/or third-party vendors and service providers ("Vendor/s"), where applicable. Title to the merchandise ("Products") will pass as applicable under the terms of the sale.

2.2. Chitra Art has the right to change or discontinue any service at any time, without notice. Chitra Art may add or modify the procedures, modes, processes, or conditions of purchase at any time. Chitra Art shall not be liable to you or to any third party for any modification, suspension, or discontinuance of any aspect of the services.

3. PRODUCT

3.1. Chitra Art enables the sale of a variety of products. Shipping for all products on the website shall be as per the company's shipping policy, which may be changed by Chitra Art from time to time.

3.2. In case you receive a damaged product, please get in touch with our Customer Service Team on +91 800 75 800 76 or write to us at chitraart41@gmail.com. The damage will be assessed and an appropriate solution will be offered. The product may be replaced or another corrective measure may be taken to address the issue.

3.3. In case the product is out of stock, our Customer Service Team will get in touch with you and a refund request will be raised. For paid orders, the refund will be processed directly to the original payment method. The money may reflect in your bank account or payment account within the applicable processing period.

4. SERVICES

4.1. You should take all responsibility for your own actions in utilizing the products purchased by you; Chitra Art shall not be liable for any such action.

4.2. You represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws applicable in India.

4.3. Chitra Art shall not be responsible for any deficiency in payment of consideration payable towards the products purchased on the website.

5. PRICING INFORMATION

5.1. The pricing information relating to the product shall be as disclosed to you at the time of your purchase.

5.2. Chitra Art does not guarantee that the price will be the lowest in the city, region, or geography. Prices and availability are subject to change without notice.

5.3. While Chitra Art strives to provide accurate information relating to products and services, including pricing information, typographical and other errors may occur. In the event that a product or service is listed with an incorrect price or incorrect information due to an error, Chitra Art may, at its discretion, contact you for instructions or cancel your order and notify you of such cancellation. If Chitra Art cancels the order after payment has been processed, the applicable amount will be refunded to the original payment method.

6. CREDIT CARD DETAILS

You might be required to provide your credit or debit card details to approved payment gateways while making a payment. In this regard, you agree to provide correct and accurate credit/debit card details to the approved payment gateways for availing services on the website.

You shall not use a credit/debit card that is not lawfully owned by you. The information provided by you will not be utilized or shared with any third party unless required in relation to fraud verification or by law, regulation, or court order.

You will be solely responsible for the security and confidentiality of your credit/debit card details. Chitra Art expressly disclaims all liabilities that may arise as a consequence of any unauthorized use of your credit/debit card.

7. DELIVERY OF THE PRODUCT

Your shipping address and PIN code may be verified before you proceed to pay for your purchase. If your order is not serviceable by delivery partners or your location is not covered by our delivery network, we may request you to provide an alternate shipping address.

If there is any dispute regarding shipment of products or services for an area not covered by Chitra Art or its delivery partners, Chitra Art will not be held responsible for non-delivery of the product.

In case you place multiple orders for products and services in one transaction, efforts will be made to ship all products together. However, this may not always be possible.

NOTE: Delivery time for premium/custom-made products may vary as such products may be prepared specifically on order. The applicable delivery timeline will be communicated on the product page or at the time of purchase.

11. INDEMNIFICATION AND LIMITATION OF LIABILITY

11.1. You agree to indemnify, defend, and hold harmless Chitra Art from and against any and all losses, liabilities, claims, damages, demands, costs, and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Chitra Art that arise out of, result from, or may be payable by virtue of any breach of any representation, warranty, covenant, agreement, or obligation made or to be performed by you pursuant to these Terms & Conditions or any additional terms applicable to the purchase of products.

11.2. In no event shall Chitra Art, its officers, directors, employees, partners, or vendors be liable to you or any third party for any special, incidental, indirect, consequential, or punitive damages whatsoever, including those resulting from loss of use, data, or profits, whether or not foreseeable or whether or not Chitra Art has been advised of the possibility of such damages.

Notwithstanding anything to the contrary, Chitra Art's entire liability to you under these Terms & Conditions shall, where applicable, be limited to the amount paid by you for the product or service giving rise to the claim.

12. GOVERNING LAW

12.1. These Terms & Conditions and the relationship between you and Chitra Art shall be governed in accordance with the laws of India without reference to conflict of laws principles.

12.2. All claims, differences, and disputes arising under or in connection with these Terms & Conditions or any transactions entered into on or through the website or the relationship between you and Chitra Art shall be subject to the applicable jurisdiction of the courts in Gujarat, India.

13. GENERAL TERMS FOR OFFERS, PROMOTIONS & CONTESTS

13.1. Chitra Art may introduce various offers, promotions, and contests from time to time. The terms and conditions for these shall be separately communicated, and Chitra Art reserves the right to change, modify, add, or delete any terms and conditions of such contests or promotions at its discretion.

13.2. While participating in such contests/promotions, you agree to release and hold Chitra Art harmless from any claims or demands arising from participation, subject to applicable law.

13.3. Winners of contests will be decided according to the specific terms communicated for the contest. Chitra Art reserves the right to determine the eligibility and selection process.

13.4. Chitra Art reserves the right to vary any of the terms and conditions of a contest, and its decision shall be valid and binding subject to applicable law.

13.5. All personal information collected during the course of a contest shall be handled in accordance with our Privacy Policy. Chitra Art may use such information for communicating marketing and promotional activities, subject to the participant's applicable choices and consent.

13.6. The participant's profile may need to be public where required for participation or verification. Entries from private profiles may not be viewable and may therefore be considered invalid where applicable.

13.7. If Chitra Art features or shares a participant's photo, this does not mean that the participant is a winner. A participant will only be considered a winner once Chitra Art explicitly declares the same.

13.8. Entries being featured on Chitra Art's Instagram handle, Facebook page, or other social media platforms are entirely at the discretion of Chitra Art.

13.9. If any entry is found to contain abusive or profane language, an attempt to attack the integrity or personality of any individual or entity, harassment, or any content that is demeaning or derogatory, such entry may be disqualified or deleted from the contest.

13.10. Any dispute based on a contest shall be subject to applicable laws and the jurisdiction of the courts in Gujarat, India.

13.11. This contest is void where prohibited by law.

14. DELAY IN DELIVERY

14.1. In case of unlikely circumstances causing a delay in the arrival of a package for reasons beyond our reasonable control, Chitra Art will not be liable for such delay. We will, however, make reasonable efforts to assist customers and provide updates regarding the shipment.
